To Cremate or Not to Cremate…

To Cremate or Not to Cremate…

When a loved one passes away, families are often forced to make emotional decisions quickly. One of the most difficult — and surprisingly common — disputes involves whether the deceased should be cremated or buried.

In Michigan, disagreements over funeral arrangements can quickly escalate into serious family conflict, especially when:

• there are multiple children,

• blended families are involved,

• a surviving spouse disagrees with the children,

• or the decedent never clearly documented their wishes.

Many people assume “the family will work it out.” Unfortunately, that is not always the case.

Disputes can arise over:

• cremation versus burial,

• funeral location,

• religious preferences,

• access to remains,

• who controls ashes,

• and even who has legal authority to make decisions.

Without proper planning, families may find themselves in Probate Court during one of the most emotional moments of their lives.

The good news is that many of these disputes can be avoided with proper estate planning documents and clear written instructions regarding final wishes.

A few conversations today can prevent major conflict tomorrow.
